1. Acceptance of Terms
By accessing or using Clocktower Tellers ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. User Accounts
3.1 Account Creation
You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access or security breach.
3.3 Account Types
We offer free and premium account tiers. Premium features require a paid subscription. Subscription terms and pricing are subject to change with reasonable notice.
4. User Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Post harmful, offensive, or inappropriate content
- Harass, threaten, or abuse other users
- Impersonate others or misrepresent your identity
- Attempt to gain unauthorized access to the Platform
- Use automated systems to access the Platform without permission
- Interfere with or disrupt the Platform's operation
- Collect user information without consent
- Use the Platform for commercial purposes without authorization
5. Content
5.1 Your Content
You retain ownership of content you post ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform.
5.2 Content Responsibility
You are solely responsible for your User Content. You represent that you have all necessary rights to post your content and that it does not violate any third-party rights or applicable laws.
5.3 Content Moderation
We reserve the right to remove or modify any User Content that violates these Terms or is otherwise objectionable. We are not obligated to monitor all content but may do so at our discretion.
6. Feedback and Reviews
Feedback submitted through the Platform is anonymous to other users but may be visible to the storyteller being reviewed. You agree to provide honest, constructive feedback and not to post false, misleading, or malicious reviews. We reserve the right to remove feedback that violates our community guidelines.
7. Payment and Subscriptions
7.1 Premium Subscriptions
Premium subscriptions are billed on a recurring basis. You authorize us to charge your payment method for the subscription fee and any applicable taxes.
7.2 Cancellation and Refunds
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods except as required by law.
7.3 Price Changes
We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
8. Intellectual Property
The Platform and its content (excluding User Content) are owned by Clocktower Tellers and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Merchantability and fitness for a particular purpose
- Accuracy, reliability, or completeness of content
- Uninterrupted or error-free operation
- Security or freedom from viruses
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOCKTOWER TELLERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE PLATFORM.
11. Indemnification
You agree to indemnify and hold harmless Clocktower Tellers and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these Terms survive termination.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of The Netherlands. Any disputes arising from these Terms or your use of the Platform shall be submitted to the competent courts of The Netherlands.
